Environmental Protection

Article 122: The construction, expansion and remodeling of industries, warehouses or workshops that imply some degree of danger or contamination to the environment in residential, recreational or tourist areas is prohibited.

Article 123: Every industry, factory or production center is under the obligation to treat waste (liquid, solid and / or gaseous) before discharging it into the environment.

Article 124: Warehouses, workshops or establishments where polluting substances are handled, are under the obligation to create the necessary protection measures, respecting Cuban environmental regulations.

Article 128: The pig agreements must guarantee the final disposal of their residuals through biogas.

Article 129: Measures for the control of flies, mosquitoes and rodents will be applied periodically in animal breeding areas so as to control and avoid the development of these vectors that can cause harmful consequences for human health.

Article 133: In the production areas, the construction, expansion and remodeling of industrial facilities that do not have treatment solutions to prevent damage to the natural environment is prohibited.

Article 134: The storage of toxic and dangerous substances within the limits of residential areas is prohibited.

Article 136: The location of productive activities that generate atmospheric, sonic or other pollution is prohibited, as well as other activities incompatible with the functions of the habitat within the residential sectors.

Article 146: The landfill will be properly fenced and will have a minimum strip of 15 meters of trees throughout its perimeter to buffer contamination by odors and vectors.

Land for development:

Building land: defined by those areas intended for the growth of human settlements that exceed the current limit given by the exhaustion of their internal potential or by the development of new developments generated by the process of new and large investments, large damages caused by events severe meteorological that demand relocations or areas reserved by urban planning plans.

About the technical infrastructure

Article 88: The delimitation of the protection area of ​​supported Tanks, Cisterns and Pumping Stations is mandatory according to current regulations.

Article 90: Hydrotechnical networks with integral solutions must be completed before starting new development areas.

Article 92: The new facilities must include the residual solution, this must be located within its limits and without visuals from the tracks, if not possible they will be masked and they will be built before the start-up of the installation.

Article 100: In areas with deficiencies in drainage, new constructions of buildings are not authorized without taking measures for protection against floods and with prior approval by the Directorate of Physical Planning and Civil Defense.

Article 103: It will not be allowed to build any type of building on technical networks, water supplies, drainage, sewerage, communication conductors and others.

Article 104: It is prohibited to place on the public highway, without permission of the DMPF, any object that may hinder transit.

Article 105: Any alteration or modification in the specific case of green areas and public spaces, will have to have the prior authorization of the Municipal or Provincial Directorate of Communal Services, as appropriate. In the case of the roads, it will also be necessary to consult the Transit.

Article 107: Street or sidewalk pits are prohibited without prior authorization from the DMPF.

Article 109: The roads and motorways must remain properly marked and in good technical condition, as well as their adjacent works painted.

Article 110: The strips on highways (6 meters) and highways (15 meters) must remain flat and clean.

Non-urbanizable soil:

Non-developable land made up of all the areas destined and used in agricultural activity, causes of rivers, streams, channels, dams and micro-dams, mineral deposits, swamps, natural forests, cemeteries or of interest to the defense of the country occupying a municipal area of 61 151, 11 hectares

Lagoon and depression area

Article 51: To achieve the adequate protection of the Flora it is prohibited:

The burning of vegetation in all areas within the area.
The use of natural vegetation for energy purposes.

Article 52: To achieve an adequate protection of the Fauna it is prohibited:

Hunting and collecting of threatened and endangered wildlife species.
The introduction of any species of fauna that endangers or alters the conservation of ecosystems or that allows the proliferation of pests and diseases.
The felling of the vegetation that serves as a refuge and source of food for the fauna.

Article 55: The dumping of pollutants for any reason through ditches, ravines or other surface current will not be allowed.

Article 57: The controlled use of chemical products and pesticides will be required according to the established technical standards.

Article 58: It is prohibited to discharge any type of chemical residuals or similar substances that may harm the natural ecosystem.

Article 61: The introduction of exotic animals and plants within the limits of protected areas is prohibited.

Article 62: The waste must be voted in places arranged for them in the General Planning Plans and that do not affect the environment.

Article 63: The existing roads and means of communication in the rural area will be respected and if necessary others will be created to facilitate accessibility to all the usufructuaries.

Article 64: The burning of crop residues will not be allowed, these must be treated and used as organic matter.

Article 66: All the measures foreseen to avoid forest fires must be maintained


Areas of mineral deposits and manifestations of aggregates:

Article 70: The construction of any building within the protection radius of mineral deposits or quarries within 100 meters is prohibited.

Article 71: The quarry exploitation areas have to be rehabilitated when the works are finished, carrying out reforestation projects.

Article 72: The construction of houses will be limited to not less than 15 meters from the existing shelters.

Article 76: The construction of works of any kind is prohibited without complying with the defense.

Agricultural activities area

Article 77: Permanent agricultural use will only be allowed in (non-urbanizable) areas whose conditions definitively prevent their use for urbanization and do not present environmental effects due to contamination of any kind.

Article 78: It is forbidden to allocate drinking water for the irrigation of green areas, organoponics, cleaning of pig pens, etc.

Sanitary protection zones

Article 120: In the forest strips of the protection zones the construction of any type of installation is prohibited.

Article 121: In the sanitary protection strips of polluting facilities, oxidation lagoons, railways and others, the delivery of land for agricultural activity for food purposes will not be allowed. Forest plantations only.

Solid waste landfills.

Article 139: Solid waste landfills will have a protection radius of 500 meters for sanitary landfill and will be properly fenced and identified.

Article 140: The construction of any object of work within the sanitary protection radius of the landfill will not be allowed, except those that are related to their operation.

Article 142: Solid wastes from health care centers (polyclinic or doctor's offices) resulting from cures, which are not incinerated, will be packed and sealed in waterproof envelopes for collection by the communal services. In no case will they be mixed with other waste.

Article 144: The grazing, permanence or existence of any type of animal within the perimeter fence of the existing landfills in the municipal territory is prohibited.
